These Terms and Conditions ("Terms") govern your use of MakeMyLPA.co.uk (the "Service"), operated by Destiny Wills & Legal Services Ltd ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms and the following policies, which form part of this agreement:

  • Privacy Policy — how we collect, use, and protect your personal data
  • Cookie Policy — how we use cookies on this website
  • Disclaimer — important limitations on the service we provide

Together, these documents constitute the entire agreement between you and Destiny Wills & Legal Services Ltd regarding your use of MakeMyLPA. If you do not agree to any of these terms or policies, you must not use the Service.

2. About This Service

MakeMyLPA provides a free online tool to help you create Lasting Power of Attorney (LPA) documents for England and Wales. We also offer optional paid services including professional document review and a print and post service.

MakeMyLPA is a document preparation tool. We are not a law firm, solicitor, or regulated legal service. We do not provide legal advice. If you have complex personal, financial, or health circumstances, we recommend consulting a qualified solicitor before completing your LPA.

3. Eligibility

To use MakeMyLPA, you must:

  • Be at least 18 years of age
  • Have mental capacity as defined by the Mental Capacity Act 2005
  • Be creating an LPA that is intended to be valid in England or Wales

By using the Service, you confirm that you meet these eligibility requirements.

4. Account Registration and Security

To use MakeMyLPA, you must create an account with a valid email address and password. You agree to:

  • Provide accurate and complete information when registering
  • Keep your password secure and confidential
  • Not share your account credentials with any other person
  • Notify us immediately if you become aware of any unauthorised use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate any account that we reasonably believe has been compromised or is being misused.

5. Free and Paid Services

Free services: Creating an account, building your LPA using our step-by-step wizard, and downloading your completed LPA documents as PDF files.

Paid services (optional):

  • Professional review — Your LPA documents are reviewed by an estate planning professional for accuracy and completeness
  • Print and post — We print your completed LPA documents and post them to you

Prices for paid services are displayed at the point of purchase. All payments are processed securely by Stripe. We never see or store your full card details.

6. Refund Policy

Refund requests must be made within 14 days of purchase.

  • Professional review: A full refund is available if the review has not yet been started. If the review has been completed, refund requests will be considered on a case-by-case basis.
  • Print and post: A full refund is available if your documents have not yet been dispatched. If your documents have already been posted, refund requests will be considered on a case-by-case basis.
  • Donations: Donations are voluntary and non-refundable.

To request a refund, please email info@makemylpa.co.uk with your order details within 14 days of purchase.

7. Your Responsibilities

You are responsible for:

  • The accuracy and completeness of all information you enter into MakeMyLPA
  • Reviewing all generated documents carefully before signing and submitting them
  • Ensuring that your LPA is signed, witnessed, and submitted in accordance with the requirements of the Office of the Public Guardian (OPG)
  • Seeking independent legal advice where appropriate

8. Intellectual Property

All content on this website, including text, design, graphics, logos, and software, is owned by Destiny Wills & Legal Services Ltd or its licensors and is protected by copyright and other intellectual property laws.

The LPA documents you generate using MakeMyLPA are yours. However, you may not copy, reproduce, modify, distribute, or create derivative works from any other part of the Service without our prior written permission.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Attempt to access another user's account or personal data
  • Interfere with or disrupt the operation of the Service
  • Scrape, data-mine, or reverse-engineer any part of the Service
  • Upload malicious code, viruses, or other harmful material
  • Impersonate another person or misrepresent your identity
  • Create an LPA on behalf of another person without their knowledge and consent

We reserve the right to suspend or terminate your account if you breach these acceptable use provisions.

10. Third-Party Links

The Service may contain links to third-party websites, including the Office of the Public Guardian, Stripe, and Trustpilot. These links are provided for your convenience only. We are not responsible for the content, accuracy, or practices of any third-party website and do not endorse any third-party products or services.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Any LPA produced by the Service will be accepted by the OPG
  • The Service will meet your specific requirements

To the fullest extent permitted by law, Destiny Wills & Legal Services Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to loss of data, loss of revenue, or rejection of your LPA by the OPG.

Our total liability to you for any claim arising from your use of the Service shall not exceed the total amount you have paid to us for paid services in the 12 months preceding the claim, or £100, whichever is greater.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited by the laws of England and Wales.

12. Indemnity

You agree to indemnify and hold harmless Destiny Wills & Legal Services Ltd, its directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your use of the Service, or any information you submit through the Service.

13. Termination

We may suspend or terminate your account and access to the Service at any time if you breach these Terms or if we reasonably believe your account is being misused.

You may delete your account at any time. Upon deletion, your personal data and LPA records will be permanently removed in accordance with our Privacy Policy.

The following sections survive termination of your account: Intellectual Property, Disclaimers and Limitation of Liability, Indemnity, and Governing Law and Jurisdiction.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, internet or telecommunications failures, power outages, government actions, or industrial disputes.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Where changes are material, we will make reasonable efforts to notify you by email or by a prominent notice on the website.

Your continued use of MakeMyLPA after any changes constitutes acceptance of the updated Terms. If you do not agree with any changes, you should stop using the Service and delete your account.

16. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
